+ g1 m! u& i" u) g《美国法典》第18篇犯罪行为与刑事诉论程序第115章叛国、暴乱及颠覆活动。该章从第2381条开始,到以下十余条中,赫然出现“叛国”、“叛乱或造反”、“煽动暴乱阴谋”、“鼓吹推翻政府”、“对武装力量进行煽动”等令人心惊肉跳的字眼,一下子把一个所谓民主自由的国家,变成了一个对反对资产阶级政权和国家或对国家不效忠的人进行无情镇压的专制国家。稍微看一看有关条款,就不难看出大讲言论自由的美国是一个典型的“以言治罪”的国家,是一个严厉镇压各种非暴力的反政府活动的国家。这一章里的第2383条“叛乱或造反”中明确规定:“任何煽动、实施、协助或进行叛乱或造反及以反对美国当局或其法律,或对上述行为给予援助或表示支持者,应判处最高至1000美元罚款或最多10年有期徒刑,或两者并罚,不得再担任任何美国公职。”第2385条“鼓吹推翻政府”中,明确认为,“任何人蓄意或故意鼓吹、煽动、劝说或讲授理由、必须、值得或宜于以武力或暴乱通过暗杀政府官员,推翻或摧毁美国政府或任何州、领地、特区或占领地政府,或任何下级政治机构和政府”就是鼓吹推翻政府罪。

+ S; s3 j5 c9 X( ?; F D% C. ?If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.

§ 2385. Advocating overthrow of Government
+ d% j& z4 q; \ _5 JWhoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or8 l5 D2 U# u# B. {9 v
Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or

Shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
